“What is negligence?” In a car accident case, it means that a driver behaved in a careless manner, which as a result harmed another person, such as another driver, a passenger, a bicyclist, a motorcyclist, or a pedestrian. For example, if a driver ran a red light and struck a pedestrian, the driver’s behavior was “negligent” because he or she was careless.
A driver must use care to follow the traffic laws. They must be on the lookout for other motorists and pedestrians, and they must not speed or drive too fast for the weather conditions. If a driver is careless, thoughtless, reckless, or otherwise negligent and they cause an accident, he or she can be sued by the people they harmed.
