When a vehicle flees the site of an accident, it can result in a senseless tragedy that is known as a hit-and-run. All too often, the hit-and-run offender leaves behind another individual who is hurt in the collision. An injured victim is left defenseless by a hit-and-run driver who flees the scene instead of seeking aid, which frequently makes the victim's injuries worse and sometimes fatal.

The family of the deceased may file a wrongful death case in Connecticut to hold the hit-and-run driver responsible in court when a driver's actions result in another person's death.

With the help of an experienced CT wrongful death lawyer, the surviving family members can seek compensation to help them deal with the aftermath of such a close death.

Brandon J. Broderick, Attorney At Law can help you get through such a tragedy. Our lawyers are here for you and strive to seek justice for our clients.

Filing A Lawsuit For a Fatal Hit And Run Accident in Connecticut

In Connecticut, the victims of fatal hit-and-run accidents can file a wrongful death lawsuit. According to state law, the wrongful death action must be filed by the executor or administrator of the deceased party's estate. But, the deceased's surviving family members, such as a spouse, children, parents or siblings can collect the damages that have been awarded to the estate. If the deceased would have been eligible to file a lawsuit had they survived the accident, the plaintiff may file one against the defendant.

Wrongful Death Statute of Limitations in Connecticut

In Connecticut, the statute of limitations for wrongful death is established in Section 52-555, which states that any lawsuit involving injuries that result in a death must be filed within two years of the deceased's death. No action may be brought more than five years after the accident or omission that is the subject of the complaint, regardless of the date of death.

This means that, even if there is an exception to the two-year statute of limitations, no claim may be made more than five years after the date of the wrongdoing.
